I am writing to respectfully urge you to support the swift passage of Bill C-355: the Prohibition of the Export of Horses by Air for Slaughter Act, currently under debate in the Senate. This critical piece of legislation addresses a profoundly inhumane practice that has no place in Canada’s modern values of compassion and animal welfare.

Every year, thousands of Canadian horses are subjected to harrowing journeys when they are tightly packed into wooden crates and flown to countries like Japan, where they are slaughtered for consumption as a raw delicacy. These flights, which can legally last up to 28 hours, often violate legal time limits for transport without food, water, or rest.

Horses endure immense physical and emotional stress, with inadequate space increasing the likelihood of injuries, collapses, and even deaths during transit.

Investigations by Animal Justice and Japan’s Life Investigation Agency have revealed the shocking realities of this practice. Evidence shows that flights frequently exceed legal time limits, and new records from the Government of Japan expose a higher rate of horse fatalities, injuries, and illnesses than Canadian reports acknowledge. This cruelty has drawn widespread condemnation from Canadians across all political affiliations.

Multiple e-petitions including one with over 77,000 signatures have been tabled in the House of Commons, reflecting the strong public demand for an end to this practice. Bill C-355 represents a narrowly focused and practical measure, targeting only the export of live horses for slaughter by air.

It does not impact the horse racing industry or the shipment of horses for other sporting purposes, or shows or personal use, all of which adhere to much higher standards of care when shipping. Furthermore, as a stand-alone bill, it cannot be amended in ways that would compromise its intent, eliminating concerns about potential overreach into other sectors.

Canada’s government pledged to ban the export of live horses for slaughter in 2021, and MP Tim Louis introduced Bill C-355 in 2023 to fulfill this promise. While the bill has successfully passed the House of Commons, it faces delays in the Senate. These delays risk perpetuating unnecessary suffering for countless horses and undermining Canada’s commitment to humane treatment of animals.

Supporting Bill C-355 affirms Canada’s dedication to compassion, empathy, and justice. It sends a clear message that we prioritize the welfare of our animals and align our policies with the values of the Canadian people. I implore you to vote in favour of this bill and advocate for its expeditious passage through the Senate.

All of the following 12 charges are related to activities of Bouvry Exports Calgary Ltd. that occurred in July 2021.

The accused party appeared in court in Fort Macleod, Alberta on August 16, 2023.

Court documents March 6, 2024 – a plea of NOT guilty was entered on all charges.

Notification of charges laid against Bouvry Exports Calgary Ltd.

Following an investigation, the Canadian Food Inspection Agency (CFIA) has laid 12 charges under the Safe Food for Canadians Act and regulations and the Health of Animals Act and regulations against Bouvry Exports Calgary Ltd., located in Fort Macleod, Alberta.

The following charges were laid under section 39(1) of the Safe Food for Canadians Act, on July 17, 2023, for alleged contraventions of the Safe Food for Canadians Regulations described below:

4 alleged contraventions of section 88 of the Safe Food for Canadians Regulations which stipulates that any person who is required to prepare, keep and maintain a preventive control plan must implement that plan

This includes programs for animal identification and welfare

1 alleged contravention of section 129 of the Safe Food for Canadians Regulations for failing to handle a food animal in a manner that does not cause it avoidable suffering, injury or death

=====

1 alleged contravention of section 130(1) of the Safe Food for Canadians Regulations which requires that a licence holder must assess whether a food animal is showing signs of suffering or injury on its arrival at the establishment

=====

1 alleged contravention of section 130(4) of the Safe Food for Canadians Regulations which requires that if a food animal is showing signs of suffering, the licence holder must immediately alleviate its suffering, humanely kill it or slaughter it in accordance with the regulations

=====

1 alleged contravention of section 165(1)(a) and 1 charge under section 165(1)(b) of the Safe Food for Canadians Regulations which establish requirements to obtain documentation related to animal identification, ownership and the last location where the animal was raised

1 alleged contravention of section 165(1)(h)(i) of the Safe Food for Canadians Regulations which requires that the holder of a licence to slaughter obtain, from the person who owned or had the possession, care or control of the food animal before its arrival at the establishment, documents providing information about the last 180 days of the life of an equine, the name of any disease or syndrome that was diagnosed or a description of any deviation from normal behavior, physiology or appearance

Two charges were laid under section 65(1) of the Health of Animals Act for alleged contraventions of subsections 140(1)(c) and 140(1)(d) of the Health of Animals Regulations which establish requirements for the humane handling and transportation of a compromised animal.

Well, thanks to Animal Justice Canada that shipper is facing federal charges.

Animal Justice has successfully laid a federal charge against a Manitoba horse export business – CAROLYLE FARMS, Swan River, Manitoba, Canada.

The charge?

Failing to have a contingency plan after a shipment of live horses from Canada destined for slaughter in Japan for human consumption, exceeded the 28-hour time limit allowed by national and international regulations governing the transport of horses.

At least 3 horses collapsed during the gruelling flight mentioned in the CBC piece. 2-minute video from the broadcast archived above.

Multiple horses are crammed in crates designed for one horse and are not fed or watered during their time in transport.

How horses are shipped to slaughter in no way resembles how show, pet or race or other sport horses are transported.

CBC’s The National carried the story of a recent shipment with Mr. Lyle Lumax admitting he knew as did the CFIA before the flight — that the horses were going to exceed the travel time allowed by both national and International regulations.

BACKGROUND…

I write on behalf of Animal Justice – Canada’s leading national animal law organization – to voice our strong support for Bill C-355, the Prohibition of the Export of Horses by Air for Slaughter Act. Shipping live horses from Canada to Japan for slaughter causes signficant and unnecessary suffering and distress to draft horses, approcimately 2,000 of whom are forced to endure this gruelling journey eveyr year.  The practice is opposed by every major animal protection group in the country, leading veterinary and animal welfare experts, and the majority of Canadians of all political stripes.  A Parliamentary e-petition in support of a ban on horse exports overseas for slaughter presented by MP Alistair MacGregor recently amassed over 36,000 signatories from across the country.

According to an article from Ontario Farmer magazine titled:

Kevin Wilson‘s diversified farming operation at Vankleek Hill [Ontario, Canada] facilitates the majority of these exports.”

By “these” exports the article means horses exported from Canada to Japan for the purpose of slaughter for human consumption.

The article goes on to say: 

“Thinly sliced horse meat, called basashi, is a sought after product in Japan and is a great export market, adding value to farmers for Canada’s surplus horses, he [Kevin Wilson] said.”

SO WHO IS KEVIN WILSON?

You may be surprised to learn that according to Facebook, Twitter and YouTube accounts and various articles in the press,  Kevin Wilson not only breeds and raises Percherons, his farm business owns 300 Percherons and he shows Percherons at fairs and events in Canada and the USA.

For years we’ve been led to believe that horses shipped to Japan for slaughter were specifically bred for that purpose, yet according to the article Kevin Wilson stated…

“Japan…”  “is a great export market, adding value to farmers for Canada’s surplus horses…”

Could it be that at least some of the “surplus” horses were not purpose bred and that some of those shipped to Japan are treated with drugs typically used on horses – for example wormers and BUTE –  drugs known to be toxic to humans?

We found that an interesting quote from someone who ships his “surplus horses” to Japan by air to be slaughtered for human consumption.

A LITTLE BACKGROUND ON KEVIN WILSON

From an article titled “Busy, successful show season for Wilson Farms Percherons” published by THE REVIEW . CA

“A full schedule of horse shows and agricultural fairs is back across Canada and the United States this year, and that has meant a busy, successful show season for Percheron draught horses from Wilson Farms of Vankleek Hill.

Draught horses have been in our blood for the last three to four generations,” says Kevin Wilson, who co-owns and operates Wilson Farms with his father, Ian Wilson. The main business of Wilson Farms is grain storage and elevation, and they also have beef cattle.

According to Kevin Wilson, the farm has around 300 Percheron draught horses, mostly being raised in Indiana, Ohio, and Missouri. Out of those 300, 11 geldings are used for shows across Canada and the United States. Many of the horses are raised for purchase by Amish farmers in the Midwestern US.”

Further down the article goes on to state:

“So far in 2022, Wilson horses have consistently been in the top five in their classes at draught horse shows locally and in the United States. At the TLA Classic Show in Topeka, Indiana, they placed fourth out of 16 entries in the Classic Series Cart Class, third out of seven teams in the Percheron Six Horse Hitch, first out of 16 teams in the Junior Cart Class, and second out of five teams in Percheron Pair Class.”

Okay, so if you are not aware, Canada allows for the live transport of horses to other countries for the purpose of slaughter.

Make no mistake about it, the way in which these horses are transported in no way shape or form resembles the way show and sporting horses are transported.

Horses are crammed in crates, often 3 or even 4 in crates designed for one horse – but don’t take our word for it – watch the full CTV W5 report here.

ITALY OFFICIALLY RECOGNIZES HORSES AS ATHLETES

ITALIAN EQUESTRIAN FEDERATION (FISE)

The Italian government has become the first to officially recognise the horse as an athlete by law, in a move welcomed as an “interesting development”.

The decision was made at the end of January by the Italian government, at a conference titled “Horse athlete: protections and prospects”, organised by the Italian equestrian federation (FISE).

The legislation means that a horse is defined as an “athlete horse” when specific requirements are met; it is registered with FISE and declared not for human consumption.

“Italy is a pioneering country in the legal recognition of the horse as a true athlete,” a FISE spokesman said.

Italy, with FISE at the forefront, is therefore a world leader for equine welfare, in particular regarding ‘athlete horses’ involved in equestrian sports.

“This is an historic decision by the Italian government.”

Representatives of the FEI, the Italian ministry of health and the International Jumping Riders Club (IJRC) were among those at the conference.

IJRC director Eleonora Ottaviani, who contributed to the debate, said: “This law provides the opportunity to finally recognise the horse as subject, and no longer object, in our sport. The well-being and welfare of horses has long been an area of mutual collaboration between the IJRC and the FEI.

“The news of the enactment of this important law in Italy was greeted with enthusiasm by the members of the IJRC. For the first time, the words ‘athletic horse’ or ‘athlete horse’ have become a legal term.”
